Honeyfund Happily Ever After Contest Terms

Beginning August 14, 2023 Honeyfund is celebrating National Honeymoon Day by hosting a contest that will send one winning couple on a 5-night trip to Villa del Palmar Cancun or Puerto Vallarta in a studio room with an all-inclusive meal package for 4 days for two people, transportation to/from airport, airfare for two up to USD $1,500, and two pairs of Hey Dude shoes.

Honeyfund’s Happily Ever After Contest (the Contest) is open to legal residents of the US or Canada who are at least eighteen (18) years old at the time of entry. Employees of Honeyfund and other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible.

The Contest is administered by Honeyfund.com, Inc. (˜Administrator’ and ‘Sponsor’), located at 2519 McMullen Booth Rd N, Ste 510-260, Clearwater, FL 33761.

Honeyfund’s Happily Ever After Contest consists of one Grand Prize which includes:

  1. 5 nights at Villa del Palmar Cancun or Puerto Vallarta in one studio room, with an all-inclusive meal package for 4 days for two people
  2. Transportation to/from the destination airport
  3. Reimbursement of airfare for two up to $1,500 (USD)
  4. Two pairs of Hey Dude shoes 

Total approximate prize value $4,200. Any expenses not mentioned above, including, but not limited to personal expenses, travel insurance, and other travel expenses are the responsibility of the winner.

Participation in the Contest constitutes full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Administrator, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. The Contest entry period begins on August 14, 2023 at 9:01 am EDT and ends on September 4. To constitute a valid entry, participants must submit a written statement or video explaining why they or someone they know (“Entrant”) is deserving of the contest prize via one of the entry methods below. The content should be original, truthful, genuine, and in compliance with the community guidelines of the respective platform.

ENTRY METHOD 1: TIKTOK

a. Follow Honeyfund on TikTok (https://www.tiktok.com/@honeyfund_official), and b. post a TikTok explaining why you or someone you know is deserving of the contest prize with the hashtag #happilyeveraftercontest in the caption of your post and tagging @honeyfund_official.

a. Follow Honeyfund on Instagram (https://www.instagram.com/honeyfund/) from a public account and b. post an Instagram Reel or photo post explaining why you or someone you know is deserving of the contest prize with the hashtag #happilyeveraftercontest in the caption of your post and tagging @honeyfund.

ALTERNATE METHOD: MAIL

Participants without Internet access can mail written entries to 2519 N McMullen Booth Rd, Ste 510-260, Clearwater, FL 33761. Attn: Happily Ever After Contest.

No purchase necessary. Participants may submit one entry per household, regardless of the method. Multiple entries from the same household, even if from different methods, will not be considered valid and will not be judged. Incomplete or incomprehensible entries, or use of automated entry software, Artificial Intelligence or other mechanical or electronic means to participate will be disqualified.

All entries become the property of Administrator and will not be acknowledged or returned. Entrant grants the Administrator permission to use the entries for promotional purposes, with or without any legally required permission of the participants or entrants.

Entries will be reviewed and judged by a panel of three judges selected by the Administrator. Judges will evaluate entries based on the following criteria: originality, creativity, relevance to the contest theme (how the prize trip will contribute to the entrant’s Happily Ever After) and overall impact. Each judge will review all valid entries and, in their sole discretion, select their top three candidates. Candidates with the most first-place votes will win. In the case of a tie, the two remaining candidates will be ranked by each judge again, and the candidate with the most first-place votes will win.

The judges’ decision is final and binding in all respects. 

The Administrator will attempt to notify the potential giveaway winner via e-mail or social media direct message on or around September 8, 2023. The Administrator will make a minimum of three attempts to contact the potential winner via the contact information provided during entry, using methods such as e-mail or direct message on the respective platform (TikTok or Instagram). If the potential winner cannot be reached within five days of the first attempt, an alternate winner may be selected. Only three (3) alternate prize winners will be selected, after which the prize will remain un-awarded.  The potential Prize winner (parent/legal guardian if a minor in his/her state of residence) will be required to complete, electronically sign and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period (if applicable), or prize is returned as undeliverable, potential winner forfeits prize.

If the potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Administrator reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winner’s behalf and fulfill any other requirements imposed on winner set forth herein. 

Potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Administrator will award the applicable prize to an alternate winner from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. All potential winners from Canada will be required to answer a time-limited skill-testing question correctly without any assistance to be eligible to receive a prize, or such prize will be forfeited.

The Prize will be fulfilled approximately 3-6 weeks after the conclusion of the Contest at which time the winner will receive booking instructions for a 5-night stay at a resort in Mexico and associated grand prize items. Travel must be completed by December 31, 2024. Blackout dates include but are not limited to November 23-27, 2023, December 22, 2023-January 7, 2024, and February 16-20, 2024. Booking is based on availability. If the winner forfeits the prize after it has been fulfilled, the prize will not be re-awarded. The prize is not transferable and must be accepted as awarded.

Prizes are considered taxable income by the U.S. Internal Revenue Service (IRS) and the Canadian Revenue Agency (CRA), as applicable. As such, the winner will be responsible for all taxes (including but not limited to federal, state, local and/or income) on the prize and will be required to provide their Social Security number or Taxpayer ID for tax reporting purposes if the value of the prize is $600 or more. The Sponsor will file an IRS Form 1099 with the Internal Revenue Service for the fair market value of the prize won by the giveaway winner who is a U.S. resident. Prize winner acknowledges that he/she will receive a Form 1099 from the Sponsor and agrees to provide whatever information is necessary for the Sponsor to comply with applicable governmental reporting requirements.

In the event that the operation, security, or administration or fulfillment of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason including natural disasters or acts reasonably beyond the control of the Administrator, as determined by Administrator in its sole discretion, the Administrator may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. If the prize cannot be fulfilled due to the above impairment, the prize will be canceled.

The Administrator reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Administrator reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Administrator to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

By participating in the Contest, entrants agree to indemnify, defend, release and hold harmless the Administrator, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d)application downloads, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Administrator is not responsible for any prize that is not timely taken or properly redeemed by any winner, or for any prize that is lost, damaged or stolen during or after shipping.

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Florida. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Administrator in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Florida, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Information collected from entrants is subject to Administrator’s privacy policy.
